Pension and Benefits Law

For generations, retirement benefits were considered a solemn promise from employer to employee.  More and more frequently, employers break that promise.  We represent employees and retirees in pension and benefit litigation, including claims and hearings before state and municipal retirement boards, where our goal is to ensure that employees, retirees and their families receive the benefits they’re entitled to.

As part of our labor practice, we also represent Rhode Island and national Taft-Hartley funds in retirement and health benefits matters, including plan formations and mergers, fiduciary obligations and plan administration.  We advise plan administrators and trustees on compliance with applicable federal and state law, including the Employee Retirement Income Security Act, HIPAA, the Affordable Care Act and COBRA. We also represent funds in collection matters to ensure that contributing employers honor their obligations, and help develop best practices relating to delinquency other policies relating to fund administration. We work closely with accountants, actuaries and administrators to promote the best interests of fund participants so that trustees satisfy their fiduciary obligations and resources remain available to provide promised benefits.
